Talent Summoner Limited ("we," "us," or "our") is an AI-agentic SaaS company incorporated in Hong Kong. We are committed to protecting the privacy and security of your personal data.

This Privacy Policy explains how we collect, use, process, and disclose your information when you use our AI-powered recruitment and career management platform (the "Service"). This policy applies to both Companies ("Clients") and Individuals ("Talents") who use our Service.

By accessing or using our Service, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

We collect different types of information depending on whether you are a Client or a Talent.

A. Information You Provide

• Account Information: Name, email address, password, and company details (for Clients).
• Talent Profile Data: Resumes (CVs), employment history, education, skills, portfolio links, and job preferences.
• Client Recruitment Data: Job descriptions (JDs), hiring criteria, interview questions, and candidate feedback.
• Sourced Candidate Data: When a Client runs a search, we collect professional information about potential candidates from publicly available sources and third-party data providers, such as name, work history, skills and public profile links, and, when the Client asks for it, contact details such as a work email address.
• AI Assistant Connectors: If you connect Talent Summoner to an AI assistant (for example Claude or ChatGPT) through our MCP server, we receive only what the assistant sends to our tools: your hiring brief, your follow-up messages, and your candidate review choices and notes. We store these in your account in the same way as if you had entered them in our app, together with a record of the connection. We do not request or receive the rest of your conversation with the assistant.
• Communications: Messages sent to us or generated via our platform (e.g., through messaging or email integrations).
• Payment Information: We use a third-party payment processor to handle billing. We do not store your full credit card details on our servers; we only retain payment tokens and billing history.

B. Information Processed via AI Agents

To provide our "Agentic" services (e.g., auto-applying for jobs, ranking candidates), our system processes your inputs through Artificial Intelligence models.

• Inference Data: Text inputs (such as JDs or Resumes) sent to third-party Large Language Models (LLMs) to generate summaries, rankings, or outreach drafts.
• Automated Instructions: Criteria you set for the AI to act on your behalf (e.g., "Apply to jobs with salary >$50k").

C. Interview and Recording Data (Where Applicable)

If you utilize our interview features:

• Recordings: Audio and/or video recordings of interviews conducted via our AI agents. We will always request your explicit consent before any recording begins.
• Transcripts: Text-based records of the conversation used for analysis and summary.

D. Technical and Usage Data

• Analytics: Pages visited, features used, and time spent using our Service. This includes session replays, which are recordings of how pages are displayed and what is clicked. Text typed into form fields is masked, except in a few fields such as the hiring brief, chat messages and contact-form messages. Content shown on screen, such as candidate names and profile details, can appear in a replay.
• Device Data: IP address, browser type, operating system, and error logs to help us fix bugs.

2. Use of Artificial Intelligence

Our Service relies on third-party AI providers to deliver core functionality.

• Inference Only: We send your data to third-party AI providers solely to generate responses ("inference"). Requests are routed through an AI gateway to several model providers, and each handles data under its own terms.
• Data Retention by AI Vendors: While we do not use your data for training, third-party AI providers may temporarily retain inputs for abuse monitoring or compliance purposes (typically for a short period), subject to their own privacy standards.
• Human-in-the-Loop: While our AI agents provide recommendations, rankings, and drafts, Talent Summoner does not make fully automated legal or employment decisions. Clients are responsible for the final hiring decision.

3. How We Use Your Information

We use your data for the following purposes:

1. Service Delivery: To create your account, process payments, and provide the agentic recruitment workflow.
2. Matching & Ranking: To analyze Talent profiles against Client job descriptions.
3. Agent Actions: To execute tasks you have authorized, such as drafting emails, refining resumes, or submitting job applications.
4. Service Improvement: To analyze usage trends and fix technical errors.
5. Communication: To send you service updates, invoices, security alerts, and notice of changes to our terms or pricing. When you create an account we also add your email address to our product newsletter; you can unsubscribe at any time in Settings.

4. Disclosure of Your Information

We do not sell your personal data. We share your information only in the following specific circumstances:

A. Sharing with Other Users (The "Marketplace")

• For Talents: We share your resume and profile data with Clients (Employers) or third-party job boards only when you explicitly instruct our AI agent to apply for a job or match you with an opening.
• For Clients: We share your job descriptions and company details with prospective Talents to facilitate applications.
• Shared Shortlists: If you create a shortlist share link, anyone who has the link can view the candidates on that shortlist until the link expires or you revoke it.

B. Third-Party Service Providers (Sub-processors)

We utilize trusted third-party vendors to operate our infrastructure. We may transfer data to the following categories of service providers, who process data on our behalf and are contractually bound to confidentiality:

• Cloud Infrastructure & Hosting Providers: To store data and host our applications.
• AI & LLM Providers: To process text and audio inputs for our AI features.
• Database Administrators: To manage and organize user records.
• Communication Services: To send emails and instant messages (such as notifications or alerts) and to provide support chat.
• Analytics, Session-Replay & Monitoring Tools: To track service performance, understand how the Service is used, and identify bugs.
• Payment Processors: To securely handle payments and subscriptions.
• Candidate Data & Contact-Enrichment Providers: To find public professional profiles and contact details for a search.
• Connected Outreach Accounts: If you connect an email or LinkedIn account, the provider of that connection, to send outreach on your behalf.
• Advertising Platforms: When you sign up, your email address is sent in hashed form to our advertising platform so that we can measure the performance of our ads.

C. Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency in Hong Kong).

5. International Data Transfers

Our Service leverages global infrastructure. Your personal data may be transferred to, and processed in, countries other than Hong Kong (such as the United States) where our third-party service providers operate. By using the Service, you consent to the transfer of information to countries outside of your country of residence, which may have different data protection rules than those of Hong Kong.

6. Data Retention

• While You Have an Account: We keep your account details, searches, candidate lists, uploaded files and outreach records for as long as your account exists. We do not delete them automatically. A search you delete is removed from your account view but stays in our database.
• After Cancellation: Cancelling a subscription does not delete your data. It is kept as described above.
• Account Deletion: Deleting your account in Settings removes your login, profile, connected accounts and payment records from our database. Your searches, candidate lists and uploaded files are no longer linked to you, but they stay in our database until you ask us to erase them.
• Service Providers: Analytics events, session replays, newsletter subscriptions and billing records held by our service providers are kept under each provider's own retention settings.
• Deletion: You may request the permanent deletion of your account and data at any time by contacting us.

7. Security

We implement reasonable administrative, technical, and physical security measures to protect your personal information. This includes encryption of data in transit and at rest where possible. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

8. Your Rights (Hong Kong PDPO)

Under the Personal Data (Privacy) Ordinance (PDPO) of Hong Kong, you have the right to:

1. Check whether we hold personal data about you.
2. Access a copy of such data.
3. Correct any data that is inaccurate.
4. Withdraw Consent: You may withdraw your consent for us to process your data (e.g., stopping the AI agent) at any time, though this will limit our ability to provide the Service.

If you are a candidate whose professional information appears in our Service, these rights apply to you too.

Controls in your account: In Settings you can delete your account, unsubscribe from the newsletter, and disconnect a connected AI assistant, email or LinkedIn account. You can revoke a shortlist share link at any time.

9. Age Restriction

Our Service is intended for individuals aged 18 years or older. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently received personal information from a child under 18, we will delete such information from our records.

10. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. We may also notify you via email or a service notification.
